Three Rivers District Council have successfully fended off future development at a cherished woodland following a High Court challenge by its owners.
The woodland had been protected by a tree preservation order, protecting it from alteration or harm since 1988.
New government guidelines were introduced in 2005 requiring the council to update the tree preservation order, the land owners claimed the order was unjustified and took legal action. A judge decided agreed with the council believing that they dealt were fully justified in protecting the site.
Tree preservation orders (TPOs) are made at the discretion of local planning authorities to protect specific trees or woodland from deliberate damage or harm.
Once granted, tree preservation orders prevent the felling, lopping, topping, uprooting or damaging to trees without the permission of the local planning authority.
